POLLUTION CONTROL RULE-MAKING
The Texas Commission on Environmental Quality (TCEQ) has proposed new agency rules relating to the so-called “Proposition 2” pollution control property tax exemption. "Prop 2" allows an industry to receive a property tax exemption for certain equipment that reduces pollution at an industry facility. The proposed rules would implement H.B. 3732, passed during the 2007 session, and would generally relate to the TCEQ's duty to maintain a list of equipment that is pre-approved to receive the exemption and eligibility for the exemption.
Related proposed rules affect the ability of cities to receive rollback property tax rate relief for compliance with certain environmental laws and mandates.
A public hearing on the rules will be held in Austin on October 26, 2007, at 10:00 a.m. at the TCEQ complex located at 12100 Park 35 Circle in Building E, Room 201S.
