Subject: Compensatory time in conjunction with FML
Compensatory time off is not a form of accrued paid
leave that an employer may require the employee to substitute for unpaid
BMLA leave. The employee may request to use his/her balance of compensatory
time for compliance for an FMLA reason. If the employer permits the accrual
to be used in compliance with regulations, 29 CFR 553.25, the absence
which is paid from the employee's accrued compensatory time "account"
may not be counted against the employee's FMLA leave entitlement. [60
FR 2237, Jan. 6, 1995; 60 FR 16383, Mar. 30, 1995]
Does your City allow employees to use their comp time when on leave for
an FMLA event? If so, how do you administer? Or, what specifically is
your policy regarding the coordination of comp time and FML? Any input

Subject: Providing services to gated subdivisions/private roads
Like many newer suburbs, Bulverde has several gated communities.
While our police respond to calls within these developments, they do not
patrol them for traffic violations. Does anyone have an ordinance that
enables the police to patrol on private roads? Since these people pay
taxes we're wanting to provide them with the services that they contribute
to. Also, we're in the process of doing a five-year road capital improvement
plan. Does anyone have any experience in including private roads in CIPs
and having the homeowners association supplement the costs for those improvements

Subject: Method of billing multi-family properties
Is there a common or standard method other cities use to
bill multi-family properties for utility and trash collection services?
Do you charge by the unit and/or the meter sizes? Do you use winter averaging?
Are these accounts considered commercial, or residential? Are vacancy

Do any Cities out there levy a special tax or fee on
their downtown. We have a downtown association who has requested that
the City tax them (that's right, they want us to impose an additional
tax) for improvements needed currently downtown. As an example we are

Subject: Legal Fees
We are interested to learn what other cities typically budget for legal
services, and what you have actually spent over the last 3-5 year's if
possible, although any time frame will be helpful. For comparison purposes,
please also address the following:
1. Is your city attorney an employee, or contracted?
2. Is he/she paid by the hour, salaried, a retainage or some other method?
3. How much per hour, etc.?
4. Do you provide any benefits?
5. Do you also use any outside attorney's for specialty reason's, such
as land use, annexation or personnel issues?
6. What are their fee's and how much do you typically spend on an annual
basis for these services?
7. Has your city been sued or threatened with litigation during this time
frame, and briefly what were the reason's (for example, former/current
employee; or, a contractor on a city job)? Have you gone through mediation?
8. Does your attorney attend all Council meeting's, or only present when
requested?
9. Has your city dealt with CCN issues or been sued by a water supply
company, either due to annexation's or dual certification/overlapping
service area's? Did you hire an attorney for this, and at what cost's?
10. Must your city attorney, and/or staff, receive explicit prior approval
from the Council before they can consult with any other attorney, for
any reason each and every time (even those you use on a routine basis)?
Does your city charter or another policy cover this?
The list turned out longer than I expected, but we would appreciate any
information that you can share with us. I'm trying to do more than a simplistic
per capita or budget-to budget comparison, because the devil is in the
details. Besides, this has become a very hot topic with our City Council

Subject: Skateboards and loitering ordinances
Currently, we do not have an ordinance that offers any controls concerning
skateboarding or loitering. I am interested to know what cities have put
in place to limit the areas of use for skateboarding. We also are beginning
to have a problem with loitering on weekends around the movie theater
and shopping center. We have not enacted ordinances for either one of
these situations yet, but want to look into it and take some action before

Term Limits and length of Terms
I know that
several Texas cities have term limits. If you are one of them, I would
appreciate knowing how term limits is working in your city. Do you have
the feeling that term limits are keeping good people from serving or is
it helping more good people with new ideas get to serve. BTW, I cannot
even get our council to discuss term limits. We have; however, discussed
increasing our term from two years to three years. This brought up the
comment, "Well, if we get a bad council person on the council. We
will have to put with them for another year". This prompted my response
of, "What makes a good council member or a bad council member".
I would greatly appreciate your input for a paper I am writing entitled,
"Good" or "Bad" Elected Officials - What Makes a "Good"
Council Person or a "Bad" Council Person? It is my intent to
offer the paper for publication in the TML magazine. I would greatly appreciate
your input into this topic and will give full credit to those who submit

Subject: Electronic or L.E.D. Signs
Recently, we have received several requests for information on our sign
ordinance regarding electronic reader boards. Currently, our ordinance
prohibits flashing, scrolling, animated, or intermittently lit signs.

Franchise Fees on Telecommunications Companies using Public Rights-of-Way
The City of Bulverde is evaluating the use of municipal
fees on telecommunication companies to use rights-of-way. Chapter 283
of Texas Local Government Code grants municipalities the ability to apply
a "right-of-way" fee on "telecommunications providers".
In our case, we are dealing with a telephone cooperative. We would appreciate
any feedback on your experiences with these fees and whether a right-of-way
usage fee can be applied to a telephone cooperative. Also, we would like
to know if this is a "pass-through" fee. Any help or advice
is greatly appreciated.

Subject: Committees/Residential Feedback
We
are a City of about 7,200 residents. We have committees set up for Public
Safety, Parks & Rec., Community Development, etc. Most of these committees
meet at night. Sometimes this causes a staff member to work two or three

a Skate Park. It seems that a new park is opening almost weekly in our

our sign ordinance does not allow temporary off site advertising signs.
A group of realtors recently approached the Council, to ask us to loosen
up on our ordinance and to allow some temporary “Open House” type signage.

fee to non-city sponsored sports leagues who want exclusive use of city-owned
athletic fields to hold league games.

Subject: Workorder and inventory software
I would like to know if any city has software that combines
(Public Works) work orders with inventory. For example, if a work order
is issued to replace a water meter, we would like to know the basic which
includes the time, date, address and customer’s name, but also be able
to track the items used which would be the water meter, any pipes, and
other miscellaneous material. We are just trying to keep a real close
control of inventory and we really don’t have an idea of the specific
materials used on any given project.
